State sues historical society over $5K grant

Pennsylvania officials sued the Frackville Area Historical Society on Thursday in Schuylkill County Court, alleging the group failed to account for $5,000 in grant money.

In the lawsuit, the state alleged the society, 123 N. Second St., neither repaid the money nor filed a grant closeout report on its disposition.

The state asked that the society be required to pay it the $5,000, plus interest and the costs of the lawsuit.

"I sent them an accounting. I will have to look into that," Diane M. Berkheiser, society president, said Thursday after being informed of the lawsuit.

According to the lawsuit, the state Department of Community and Economic Development and the society signed an agreement on May 2, 2009, under the terms of which the society was to receive $5,000 for community revitalization assistance. The society was to use the money to buy a collection of historical items, according to the lawsuit.

DCED and the society amended the agreement on July 11, 2011, allowing the latter to use the money to buy three display panels, four display cases, carpeting and display lighting, according to the lawsuit.

However, the society still had to abide by the remaining terms of the original agreement that required it either to file the report or return the money, the lawsuit reads in part.

The society has done neither, according to the lawsuit.
