Criminal Court, Nov. 22, 2013

In recent Schuylkill County Court action, Judge John E. Domalakes on Wednesday accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Robert C. Lutsey, 25, address not known; two counts of simple assault and one each of possession with intent to deliver a controlled substance, criminal use of a communication facility, resisting arrest and theft; eight to 23 months in prison with immediate parole, $100 payment to the Substance Abuse Education Fund, $50 payment to the Criminal Justice Enhancement Account, $1,455.34 restitution, 40 hours community service and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew charges of possession of a controlled substance, criminal mischief, receiving stolen proeprty and conspiracy.

Kevin M. Mabry, 27, of Allentown; theft; three to 12 months in a state correctional institution consecutive to current sentence. Prosecutors withdrew charges of burglary, receiving stolen property and criminal mischief.

Pottsville police had charged Mabry with stealing from his grandparents on May 26 in the city.

"So you stole from your grandparents?" Domalakes asked Mabry.

"Yes," Mabry answered.

"I don't imagine you're proud of that."

"No."

"Why did you do that?"

"Drugs."

Carlton D. Mayo, 31, of Reading; accident involving death or injury and driving under suspension; three to 23 months in prison, $200 fine, $50 CJEA payment, $3,160.75 restitution and 20 hours community service. Prosecutors withdrew charges of driving without a license and disregarding traffic lane.

Corey J. Mlynek, 20, of Pine Grove; two counts of terroristic threats and one of failure to disperse; three to 23 months in prison with immediate parole, $100 in CJEA payments and mental health treatment. Prosecutors withdrew charges of criminal trespass and harassment.

"I fully expect you to cooperate with that treatment," Domalakes told Mlynek.

All defendants who were sentenced must pay costs as a part of their sentences.
