PORT CARBON — A New Philadelphia woman charged with pulling out a handgun and discharging it near the head of a man on April 6 in the area of Wiggan and Middle streets in New Philadelphia appeared for a preliminary hearing before Magisterial District Judge David A. Plachko.
Kathleen A. Fogarty, 41, 132 Water St., appeared on charges of two felony counts of aggravated assault; one misdemeanor charge each of simple assault and recklessly endangering another person; and a summary charge of disorderly conduct.
Prosecutors withdrew one of the aggravated assault charges, and Fogarty waived the remaining four charges to Schuylkill County Court.
New Philadelphia police Patrolman Ryan Murphy charged Fogarty with confronting Melissa Davis over a dog. During the confrontation, Davis’ boyfriend, William Goralewski, exited the home and he and Fogarty began to yell at each other.
At one point, Murphy said Fogarty pointed a 9mm handgun at Goralewski and told him to stay back but the man pushed her to the ground two times, prompting the woman to point the weapon at Goralewski and fire a shot that just missed him.

TAMAQUA — A borough man arrested by Tamaqua police for a theft and also for threatening three police officers on April 14 waived his right to a preliminary hearing before Magisterial District Judge Stephen J. Bayer.
Daniel Leary, 35, of Hegarty Towers, 101 Pine St., Apt. 4, was arrested by Tamaqua police Patrolman Richard Bekesy and charged with three counts of disorderly conduct and one count each of terroristic threats and retail theft.
By waiving his right to a hearing, Leary will now have to answer to all three charges against him in Schuylkill County Court.
Bekesy charged Leary after a 9:36 a.m. incident during which Leary was in the Family Dollar Store and seen stealing items by another man. Leary exited the store and was confronted by Bekesy, who ordered him to stop, Chief Richard Weaver and Cpl. Henry Woods. Leary refused to obey the order.
After disobeying commands and yelling threats and profanities at Bekesy, Weaver and Woods, Leary was subdued with a Taser and taken into custody.
When in handcuffs, Bekesy said Leary was searched and found with items valued at $7.69 that were stolen from the store.
