A Frackville man is headed to state prison after being sentenced Monday in Schuylkill County Court.
Harry R. Baney III, 30, must spend one to two years in a state correctional institution, Judge Jacqueline L. Russell ruled.
Russell imposed the sentence after revoking Baney’s probation, which the defendant admitted violating.
Baney originally pleaded guilty on Nov. 24, 2009, to false report to law enforcement, with prosecutors withdrawing a charge of receiving stolen property. At that time, Judge Charles M. Miller placed Baney on probation for 12 months and also sentenced him to pay costs.
Frackville borough police charged Baney with making the false report on May 20, 2009, in the borough.
In a Tuesday case, Judge James P. Goodman sentenced Rodney A. McDonald, 22, of Schuylkill Haven, to serve four to 23 months in prison.
Goodman sentenced McDonald after revoking his probation.
McDonald originally pleaded guilty on June 19, 2013, to two counts each of theft from a motor vehicle and receiving stolen property and one of loitering and prowling at nighttime.
Prosecutors withdrew charges of conspiracy, criminal mischief and purchase, consumption, possession or transportation of an intoxicating beverage.
At that time, Goodman placed McDonald on probation for 36 months and also sentenced him to pay costs, a $100 fine, a $50 Criminal Justice Enhancement Account payment and $58.30 restitution, amounts McDonald still must pay under the terms of Tuesday’s sentence.
Schuylkill Haven borough police alleged McDonald committed his crimes on March 19, 2010.
