Man jailed on assault charges

A 25-year-old city man was jailed Saturday after Pottsville police responded to a report about 2:27 a.m. of a man with a gun.

Dustin R. Ballard, 375 S. Centre St., was charged with simple assault, terroristic threats and recklessly endangering another person, all misdemeanor offenses.

According to court documents, officers were called to 12 N. 11th St. where a woman reported Ballard showed up at her front door brandishing a black handgun and asked her, "Where is your son at?"

The woman said Ballard is a friend of her son and recognized him from prior occasions.

Police said the woman said she feared for her life and closed and locked the front door and that she did not know why Ballard was at her home.

About 2:45 a.m., police said officers were called to 375 S. Centre St. for a report of a disturbance where they found Ballard and India Miller arguing in the street and they detained Ballard for questioning.

The investigation determined that India Miller went to the apartment where Ballard lives with his estranged girlfriend, Canel Miller, to confront him about a prior incident.

After that confrontation, police said, Canel Miller discovered that her black Glock handgun was missing from a bedroom where India Miller had confronted Ballard.

Police said that officers found a box of ammunition in the bedroom with 10 shells remaining, an empty bullet magazine, a separate copper jacket and a synthetic holster.

Officers also found a large black jacket that matched the description given to them by the woman on 11th Street.

India Miller reported that Ballard had a black handgun and a physical struggle began after he brandished the weapon. The altercation continued onto South Centre Street where police found Ballard and India Miller.

Meanwhile, authorities are working to see if an incident hours earlier is related to the threats by Ballard and the handgun reported missing by his estranged girlfriend.

About 10:15 p.m. Friday, police said officers were called to an incident where shots were allegedly fired on South Centre Street.

Police said officers responded for a reported argument at the 300 block of South Centre Street and learned that shots had been fired at 375 S. Centre St., Ballard's address.

A resident reported seeing a person in a black hoodie walking outside near the building and a black Honda with tinted windows parked across the street, police said.

Police said the resident heard the shots shortly after seeing the person.

The investigation into that incident is continuing, police said.

Ballard was arraigned by on-call Magisterial District Judge Anthony J. Kilker, Shenandoah, and committed to Schuylkill County Prison unable to post $15,000 straight cash bail.
