A woman who said she no longer can have children received nothing Thursday from a Schuylkill County jury that ruled in favor of the Palo Alto doctor who cared for her.
Kelly Clark wept as the jury of six men and six women found Dr. Ilene Katz Weiser was not negligent and did not commit malpractice in treating her during and after her pregnancy in 2008.
Jurors took about 15 minutes to render the unanimous verdict that ended the four-day trial over which President Judge William E. Baldwin presided.
Katz Weiser and Clark each testified during the trial.
Clark had filed the lawsuit on Aug. 19, 2010, alleging Katz Weiser had left placental tissue in her uterus following the delivery of her daughter on Aug. 22, 2008. Asherman's syndrome and the inability to have more children resulted, Clark alleged.
"I was extremely angry at that point," Clark had testified. "The problem wasn't fixed. I wanted to be back to me. I wanted to be back to normal."
On the other hand, Katz Weiser, who has been practicing medicine in the county for 20 years, had testified that the delivery went well and she removed Clark's placenta.
"She did not remove her own placenta," Katz Weiser said of Clark. "I was not rushed."
